Student's MySpace Rant Is Protected Speech, Says Court

The Indiana Court of Appeals has ruled that a student's obscenity-filled MySpace post blasting a school principal is protected free speech. The student, who is identified as "A.B." in court documents, was originally placed on probation by a lower court judge in Indiana after she commented about her body piercings and school policy on a MySpace page created by another student.

AP - Here's another reason for ailing newspaper and magazine publishers to wince: On average, the audience perusing unauthorized online copies of their articles is nearly 2.5 times larger than the readership on their own Web sites, according to a study being released Thursday.


Microsoft: Not all information can be free

A top Microsoft lawyer made the case on Thursday that sites like Google News are making money while the folks creating that digital content aren't able to make a living.

Google News, said Thomas C. Rubin, makes $100 million a year, while the newspapers that power its content are having to cut staff in record numbers.

"Clearly this can't be the future for publishing," Rubin said, according to his prepared remarks delivered to the UK Association of Online Publishers. Rubin is Microsoft's chief counsel for intellectual property strategy.

United States: Drug Warning Claims 'Impliedly Preempted' But Asks High Court To Hold Off

WASHINGTON, D.C. - The U.S. solicitor general on Dec. 21 told the U.S. Supreme Court that failure-to-warn claims involving a drug are barred by implied preemption, but he urged the court not to take up the case until it issues preemption rulings in separate drug and device cases that are pending (Wyeth v.
