Incentive Payments Nixed From $49 Million BAR/BRI Settlement
A federal judge approved a roughly $49 million settlement in the BAR/BRI class action Monday -- but only after rejecting incentive payments to five class representatives, claiming they had a conflict of interest. The judge also delivered lower attorney fees than previously suggested for the class action, which alleged that West Publishing and Kaplan Inc. cut a secret deal to give West's BAR/BRI a virtual monopoly over bar review courses, and Kaplan less competition in LSAT preparation classes.
Hundreds weigh in on net neutrality
(InfoWorld) - Hundreds of groups and individual Internet users sounded off to the U.S. Federal Communications Commission (FCC) on net neutrality in comments filed Monday, the deadline for responding to the agency's inquiry into the proposed regulation.
Individual Internet users, trade groups, and advocacy organizations filed about 670 comments about net neutrality rules with the FCC Monday. Individuals and organizations have submitted nearly 29,000 comments on net neutrality since the FCC opened its inquiry in late March.
Net neutrality advocates want the FCC or the U.S. Congress to prohibit large broadband providers like AT&T and Comcast from blocking or slowing Web content from competitors.
Many of the comments Monday came from individual Internet users who asked the FCC to protect them against new fees that they fear broadband providers could charge Web content providers.
"Keep the corporations off our rights," wrote Internet user Jack McFarley of Washington state in an e-mail that was part form letter. "Net neutrality is essential to free speech, equal opportunity, and economic innovation in America."
Bonnie Bennett of California seemed to take a more individual approach in her e-mail to the FCC. "Free, unlimited access to the Internet is the modern-day version of how to educate the citizenry of a well-functioning democracy," she wrote. "Big companies and global corporations care a lot about profits and stockholders but not much about educating citizens."
A technology director of a school in Mississippi said net neutrality rules would protect his students' ability to access the information they need. "The importance of the Internet is increasing each month," wrote David Scovic. "Many small innovative Web sites that are vital to our teaching would be affected by a no vote [on net neutrality rules]."
Net neutrality advocates have argued that such rules are needed after decisions by the FCC and the U.S. Supreme Court in 2005 allowed broadband providers to stop sharing their networks with competing Internet service providers. The debate over net neutrality heated up after Ed Whitacre, former CEO at AT&T, complained in BusinessWeek in late 2005 about potential competition from Internet companies, saying he wasn't going to let them "use my pipes free."
In March, the FCC launched an inquiry to examine net neutrality proposals, looking at whether broadband providers charge different prices for different speeds and how consumers are affected by the ways broadband providers manage their networks.
Hands Off the Internet, an advocacy group representing AT&T, Alcatel-Lucent, the American Conservative Union and other organizations, said in its filing that net neutrality advocates haven't shown the need for new regulations. Broadband providers aren't blocking competing content, the group said.
"There is no current or anticipated content discrimination or service degradation justifying new regulations by the commission," wrote Christopher Wolf, cochairman of Hands Off the Internet. "Moreover, regulation could well thwart Internet growth and make consumer access unfairly expensive."
The Computer & Communications Industry Association, a trade group representing Microsoft, Google, and other tech vendors, said a net neutrality rule is needed because there's little competition among broadband providers. Broadband providers "insult the commission's expertise by summarily proclaiming the broadband access market competitive without any specific evidence of competition," the group said.

Part of the enduring appeal of Batman is that he accessorizes. He was toyetic before toyetic was even a word. A horrible, horrible word.
In that sense, he's much like those who fanatically follow his adventures: He avoids the sun, dresses in a, shall we say, idiosyncratic manner, collects neat stuff and spends a lot of time on a computer looking for excuses to get into fights. We'll just gloss over the fact that he's in tip-top physical shape and probably doesn't have the complete Buffy series on a hard drive somewhere.
This, then, is Part 2 of our look at Batman's stuff. We look at the Dark Knight's various possessions, and subject them to the harsh, cold light of judgment. Because when you don't spend every night wiping crime from the streets like a vengeful Mr. Clean Magic Eraser, you have plenty of time to write stuff like this.
Batcave
The Batcave has aged well. Underground bunkers never go out of style! If anything, in this age of constant surveillance your secret base would have to be underground to avoid space lasers and Google Maps. I am, however, disappointed whenever the Batcave is depicted without a life-size dinosaur statue. I don't care how gritty and morally ambiguous your story is, there's always room for an anatomically inaccurate T. rex. On the other hand, Wikipedia informs me that the Batcave originally just held a desk and filing cabinets. Bat-cubicle!
Grade: A
Rebreather
This is usually depicted as a small device that Batman can hold in his mouth like a Binky. A Bat-Binky. However, rather than providing Batman with comfort while teething or tripping on ecstasy, the rebreather turns Batman's superheroic exhalations back into life-giving oxygen, allowing him to survive unpleasant gases or even breathe underwater. Carbon dioxide into oxygen? Batman could solve global warming on his own, but he won't. Global warming didn't kill his parents.
Grade: C+
Batplane
I'm not even going to consider how Batman deals with air-traffic control. I assume he just tells them he's the god-damned Batman and they'd better get all the other planes out of the sky because some villain is launching a series of awkwardly themed crimes and needs to be flied at. I like to think that Batman also has another Batplane, a simple woodworking tool he uses for home improvement. One shaped like a bat.
Grade: B
Explosives
Batman has explosives? Many sources agree. It seems to me that if you have explosives you don't need much else. Really, Explosives Man is probably going to frighten more cowardly, superstitious criminals than a bat theme. Criminals have one main superstition: "If someone explodes you, you die." Yeah, I know Batman doesn't kill, but if he plays his cards right, nobody ever has to find that out. Just convince them you're completely crazy. In that outfit, that's not tough to do.
Grade: C-
Flashlight
In some incarnations, Batman has night-vision lenses, but I like it when he just has a plain old regular flashlight. Why? Because I carry a flashlight. That means I am, in some small way, like Batman, if Batman had a key chain. Which I guess he doesn't? At any rate, I'm hoping in the future Batman will carry around a Leatherman, a BatPod MP3 player and a miniature bottle of Tabasco. Then the parallels will be uncanny.

Shark-Repellent Bat Spray
Whenever I talk about Batman's utility belt -- and I do that far too often -- someone always mentions the Shark-Repellent Bat Spray from the Adam West Batman movie. Yeah, that was pretty awesome.
